- A foreclosure generally
starts with a lender recording a Notice of Default (NOD). You may receive several collection calls and letters preceding
this notice that may seem like a foreclosure notice, but it does not officially begin until this NOD is recorded. The
90 day period runs from the date this NOD is recorded.
- What is a Notice of Trustee Sale ?
- After
the 90 day period has run, the lender can record a Notice of Trustee Sale and sell your home at an auction in about 20 days.
- What happens after the auction ?
- The lender (or other purchaser) becomes the owner and can
now evict you.
- How does bankruptcy stop foreclosures ?
- A Chapter 7 temporarily delays a foreclosure,
but a Chapter 13 (assuming you meet the qualifications) can save your home from foreclosure.

- What is a Chapter 7 ?
- This is the most simple, liquidation form of bankruptcy. If you own a home,
you can still keep your home in most cases if homestead exemptions in the amount of $75,000, $100,000 and $175,000 (depending
on your status).

- This is the individual repayment plan where you keep your
assets and pay what you can afford.
- What is a Chapter 11 ?
- This bankruptcy is usually reserved
for large corporations, businesses or individuals with larger debt than allowed by the Chapter 13.
